Terms of Service

These Terms of Service ("Terms") govern your use of Haircut Right (the "Service"), operated by Filabs ("we", "us"). By creating an account or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use the Service on your own. Users under 16 may use the Service only with the verifiable consent of a parent or legal guardian, who agrees to be bound by these Terms on the minor's behalf. We may request proof of parental consent before activating an account and may suspend or terminate the account if consent cannot be verified.

By using the Service, you confirm that you meet the age requirement and have the legal capacity to enter into this agreement in your country of residence, or that a parent or legal guardian has consented on your behalf.

2. What the Service does

Haircut Right lets you upload a photo of your own face and receive AI-generated previews showing how a chosen hairstyle could look on you. The previews are illustrative and are not medical, dermatological, or styling advice.

3. Your account

• You are responsible for the accuracy of the information you provide and for the security of your sign-in credentials.
• You must not share your account with another person or let someone else sign in with it.
• You must notify us promptly if you suspect unauthorised access.
• We may suspend or terminate an account that violates these Terms or applicable law.

4. Acceptable use

You agree not to:

• Upload a photo of any person who is not you, unless that person is an adult who has explicitly consented to the upload and the processing described in our Privacy Policy. This prohibition includes any photo of a minor other than yourself.
• Upload nudity, sexually explicit content, content depicting violence, or content that violates anyone's dignity.
• Use the Service to impersonate any real person, including public figures, or to generate content intended to deceive or defame.
• Use the Service to identify, track, or build a database of real individuals.
• Attempt to extract, reverse-engineer, or interfere with the underlying AI models, prompts, or infrastructure.
• Use automated scripts, scrapers, or any access method that bypasses normal browser use.
• Resell or commercially redistribute the Service or its output without our written agreement.
• Use the Service for any unlawful purpose or in violation of any applicable law.

We may remove content, suspend access, or terminate an account that breaches this section without prior notice when necessary to protect users or comply with law.

5. Your content and the licence you grant us

You keep ownership of the photo you upload and of the previews generated from it. To provide the Service, you grant us a limited, non-exclusive, worldwide, royalty-free licence to:

• store your photo and the generated previews for the duration set out in the Privacy Policy;
• transmit your photo to our AI sub-processor strictly to produce the result you requested;
• display the previews back to you.

We do not use your photo or the generated previews to train any AI model, and we do not licence them to any third party for any other purpose. This licence ends when the photo is deleted in accordance with the Privacy Policy.

6. AI output disclaimer

The previews are produced by an AI model and are probabilistic illustrations, not photographs of you after a real haircut. They may contain inaccuracies, distortions, or features that do not match reality. Do not make irreversible decisions — including booking, cutting, or chemically treating your hair — based solely on a preview. Consult a qualified hairstylist before any irreversible change.

7. Intellectual property

The Service, including its software, interface, content, branding, and the underlying models we license, is owned by us or our licensors and is protected by intellectual property law. These Terms do not transfer any of those rights to you. You may use the Service only as expressly permitted here.

8. Paid features

Some features require payment. Prices, billing cycles, and refund terms are described in our Terms of Sale. The Terms of Sale apply to every paid transaction in addition to these Terms; where the two documents conflict on a paid-transaction question, the Terms of Sale prevail.

9. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties not expressly granted here, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that previews will meet any subjective standard of accuracy or quality.

10. Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to the Service is capped at the greater of (a) the total amount you paid us in the twelve months preceding the claim, or (b) one hundred euros. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms excludes liability that cannot be excluded by law (for example, liability for gross negligence or wilful misconduct).

11. Indemnity

You agree to indemnify and hold us harmless from any claim brought by a third party arising from content you upload in violation of section 4, or from your use of the Service in violation of law or these Terms.

12. Term and termination

These Terms apply for as long as you use the Service. You may stop using it and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (intellectual property, disclaimers, liability, indemnity, governing law) survive.

13. Governing law and jurisdiction

These Terms are governed by French law, without regard to conflict-of-laws rules. Any dispute is submitted to the competent courts of Paris, France, except where mandatory consumer-protection law gives you the right to sue in your country of residence.

14. Changes to these Terms

We may update these Terms when the Service, our practices, or applicable law changes. Material changes are notified to active users by email at least 30 days before they take effect. Continuing to use the Service after the effective date means you accept the new version.
